Terms and Conditions.

 

These Terms and Conditions apply to all services and products purchased from Skytrek Flying School Limited and may change from time to time without notice.

 

1. Skytrek Trial Lesson and Experience Flight Vouchers.

All vouchers are valid for six months from the date of purchase (in the case of e-gift vouchers they do not expire) and must be booked for the trial lesson or flight experience to take place within the validity period of the voucher. Vouchers are strictly non-refundable and have no cash value. The expiry date is shown on the voucher and an extension may be available on payment of an administration fee or, if you have attempted to make a booking which had to be postponed by us for operational reasons, or the validity period of the voucher has been extended by us in writing for some other reason under these terms and conditions.

 

Once you have booked the date of your flight, at least 48 hours’ notice is required if you wish to make any amendments to the date or time. We cannot guarantee to offer a weekend booking or to fly you on a particular date until booked, but we will make every endeavor to do so. All flights must be pre-booked with our Operations Team on 01634 200787. Vouchers can be transferred to another name free of charge or the validity date extended on the payment of an administration fee. All flights commence and terminate at Rochester Airport, Kent and all flight times are “brakes off" to “brakes on”. All flying operations are seasonal and entirely weather dependent. Should you fail to attend the agreed booking date and time without appropriate notice then the voucher will be forfeited and no re-booking allowed.

2. Third Party Vouchers.

Skytrek accept bookings for vouchers that are Skytrek branded sold by Flights 4 All. These vouchers are bound by the terms and conditions of the relevant company and Skytrek act as a service provider to them. Redemption of third party vouchers are subject to the same terms and conditions as item 1 above.

3. Face value vouchers and online e-Gift cards.

Skytrek face value vouchers and online e-gift cards never expire and can be used to purchase any services or products offered by us. In accordance with UK law, there is a 14 day cool down period after purchase, in which time the face value vouchers and online e-Gift cards can be refunded in full if not used, after which time they are strictly non-refundable and have no cash value.

​4. PPL (A) Starter Packs and ‘Special’ offers.

Five hour starter packs and any other special deals offered from time to time are discounted and are strictly non-refundable as they are sold as a complete item to include the stated flying time of the pack, the services provided and equipment included. Purchases should be carefully considered prior to making payment. All additional non-flying items such as ground school, equipment, exams, etc. should be paid for separately and cannot be deducted from your account unless agreed by Skytrek Operations staff. If due to exceptional circumstances and entirely at the discretion of Skytrek Flying School Limited, a refund is allowed, then the hours flown, membership fees and materials provided will be re-calculated at the standard rate at the time of cancellation and an administration fee of £59 including VAT, will be charged. 

 

5. Student Pilot and Pilot Membership Fee.

Membership fee are paid annually and are valid from 1st January to 31st December each year. New members will be charged a pro-rata basis for the period to 31st December, dependent on the date they join and all fees are non-refundable. All persons flying in Skytrek operated aircraft must hold a current membership with all fees fully paid in advance. Persons undergoing a “trial flying lesson” are exempt as the temporary membership for the flight is included in the voucher price. Annual membership will automatically be deducted in January each year from in credit pre-payment accounts.

 

6. Student Pilot and Pilot Member Accounts.

Skytrek Flying School is Pay As You Go and we do not require students or members to have a pre-payment account. Should you wish to open a pre-payment account with Skytrek we will be pleased to arrange this for you. All pre-payment accounts must be kept in credit. For members with a positive cash balance on their authorised pre-payment account, refunds will be made of the outstanding balance and requests for refunds must be made in writing by the member. Refunds will always be made to the person who paid into the account and if originally purchased by credit card, the refund will be credited to the same card. Accounts with no transactions for a period of five years, will be considered dormant and not be refunded.

 

7. Student Pilot and Pilot Member Flying Charges.

The charges for flying instruction and hire of aircraft shall be fixed by Skytrek Flying School Limited and may be subject to revision from time to time. The appropriate charge must be paid immediately upon the completion of any training flight unless arrangements have been made to open an account with Skytrek Flying School Limited and it is positive balance.

 

8. Student Pilot Member Lesson Booking (not applicable to trial lesson vouchers)

All bookings must be made via and approved by our Operations Team. Subject to the availability of an aircraft and/or a flying instructor, a student or member may book a time for instruction or the hire of an aircraft in advance. Payment for advance booking must be paid at time of booking. The student or member must be available at least 30 minutes prior to that time. Cancellation of any bookings, must be notified to the Skytrek operations staff no later than 24 hours prior to the booking commencement time. Cancellations made with less than 24 hours’ notice will attract a minimum £45 charge for each hour (or part thereof) of booking cancelled. Exemptions will only be made under exceptional circumstances and entirely at the discretion of Skytrek Flying School Limited. Members failing to be present at Skytrek for the commencement of a booking or arriving too late to allow the flight to be fulfilled, will be deemed as having made a late cancellation and will be charged in accordance with the Skytrek cancellation policy. Cancellation of bookings for weather related reasons must be agreed with a member of the Skytrek Operations staff in advance of the booking commencement time.

 

9. Pilot Member Self Fly Hire Bookings

All bookings must be made via and approved by our Operations Team. Subject to the availability of an aircraft, a  Pilot Member may book in advance a time for the hire of an aircraft and must be available at least 30 minutes prior to that time. Payment for advance booking must be paid at time of booking. Cancellation of any bookings, must be notified to the Skytrek operations staff no later than 24 hours prior to the booking commencement time. Cancellations made with less than 24 hours’ notice will attract a minimum £45 charge for each hour (or part thereof) of booking cancelled. Exemptions will only be made under exceptional circumstances and entirely at the discretion of Skytrek Flying School Limited. Pilot members failing to be present at Skytrek for the commencement of a booking or arriving too late to allow the flight to be fulfilled, will be deemed as having made a late cancellation and will be charged in accordance with the Skytrek cancellation policy. Cancellation of bookings for weather related reasons must be agreed with a member of the Skytrek Operations staff in advance of the booking commencement time.

We want all our members to enjoy our aircraft so we have some minimum times for aircraft taken away from Rochester for long periods of Self Fly Hire. These are as follows, but may be waived or reduced subject to aircraft availability.

 

C172 - Weekdays (excluding Bank Holidays) - If the aircraft is booked for 4 hours there is a minimum charge of 1 hour and over 4 hours, 2 hours.

C172 - Weekends & Bank Holidays -   If the aircraft is booked for 4 hours there is a minimum charge of 2 hours and over 4 hours, 3 hours.

C152 - Weekdays (excluding Bank Holidays) - If the aircraft is booked for 4 hours there is a minimum charge of 2 hours and over 4 hours, 3 hours.

C152 - Weekends & Bank Holidays -   If the aircraft is booked for 4 hours there is a minimum charge of 2 hours and over 4 hours, 4 hours.

 

For overnight and longer periods, please discuss with the Skytrek Operations Team.

 

Should the member be unable to return the aircraft to Rochester Airport, or the aircraft be damaged, the hirer member will be responsible for all costs associated with Skytrek recovering the aircraft and/or the repair of any damage caused.

 

10. Flights.

All flights are subject to suitable weather conditions, aircraft serviceability and safety. Skytrek Flying School Limited do not accept responsibility for airport restrictions, bad weather, mechanical problems or unforeseen events causing the contracted flight to be cancelled or altered. Skytrek Flying School Limited cannot be held liable for any costs incurred in this circumstance. It is the responsibility of the flyer to call for a weather check prior to setting off on the day of the flight with our Operations Team on 01634 200787. If the flight is cancelled for whatever reason, it is your responsibility to re-book your flight with us. If you fail to arrive by your scheduled reporting time on the day of your pre-booked flight, or do not present your flight voucher, then you forfeit your flight and may be subject to additional charge as detailed in 7 and 8 above. 

 

11. Fit To Fly

We are not qualified to express an opinion confirming that you are fit to fly and you must ensure that you are fit to fly. You must not fly if you are suffering from any serious medical condition (including epilepsy, fits, severe head injury, high blood pressure or heart conditions), or have recently undergone surgery, unless you have a certificate of your fitness to fly from your doctor. You must not fly if you are pregnant or under the influence of alcohol or drugs. The Flyer is responsible for advising the Company of any disabilities or problems of health that might affect personal safety. The Flyer must not have consumed any alcohol prior to the Flight and we will be entitled at the time for any Flight to prevent a Flyer from flying who in our opinion may have consumed alcohol beforehand. No Flyer will be allowed to take part in any Flight unless they have attended the full safety briefing preceding the flight.

 

12. How we use your personal information (General Data Protection Regulations)

All personal information that you provide (including, but not limited to, your name and address) will be collected, held and used solely for dealing with you as a customer of Skytrek and will only be stored to 1) Provide our goods and services to you 2) Process your payment for the goods or services 3) Communication regarding Skytrek events and benefits. By purchasing a product or service from Skytrek Flying School Limited, you authorise the Company to store the information provided in relation to the purchase, which will be kept in both manual and electronic storage systems. Your details will never be used outside of the Company or passed to a third party.

 

13. Cancellations due to weather or runway conditions.

All flying operations are seasonal and entirely weather dependent. It is the responsibility of the student to call the Skytrek Operations staff on the morning of their flight to ascertain whether or not the flight or lesson can go ahead. This decision is at the discretion of the Instructor. No refunds are available due to bad weather, but the lesson can be re-booked.

 

14. Validity

These Terms & Conditions do not affect your Statutory Rights and shall be governed by and construed in accordance with English Law. The parties agree that the English courts have exclusive jurisdiction to adjudicate any dispute which arises in connection with these Terms & Conditions.
